In response to the unprecedented crisis presented by COVID-19, Congress has passed legislation responding to the pandemic and its economic fallout that together totals trillions of dollars. The Congressional Budget Office says that the federal government is on track to spend more than $3.3 trillion more than we take in this year, without any new COVID legislation.
To better help taxpayers, members of Congress, their staff, and others understand the full budgetary effect of the federal COVID-19 response, the Senate Budget Committee is aggregating this information in one user-friendly digest.

Types of Emergency Spending
There are currently three separate emergency designations available to senators for budget enforcement purposes in budget law and rules. Each of these designations can exempt the budgetary effects of covered provisions from specific enforcement regimes. These designations, discussed briefly below, can be challenged by any senator through the point of order process. The emergency designation points of order require 60 votes to waive, if raised. If sustained, the point of order removes the emergency designation from the pending measure and makes the budgetary effects of the provision subject to standard enforcement.
- The Budget Resolution’s Section 4112.
- found in Section 4112 of the Concurrent Resolution on the Budget for Fiscal Year 2018, H.Con.Res.71;
- provides the authority to designate provisions of direct spending or receipts legislation (generally produced by one of the authorizing committees) or appropriations for discretionary accounts (produced by legislation from the Appropriations Committee) as an emergency; and
- prevents Senate scorekeepers from including the budgetary effects of designated provisions in their calculations for enforcement.
- BBEDCA’s Section 251.
- found in section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 (BBEDCA);
- allows for cap adjustments to statutory discretionary spending limits, with the only requirement being that Congress designate and the president agree;
- triggers the chairman of the Budget Committee to file changes to the Appropriations Committee’s allocation and budgetary aggregates to accommodate the emergency spending and prevent levels-based points of order (314(a) of the Congressional Budget Act of 1974); and
- gives the Office of Management and Budget (OMB) the ability to adjust the statutory caps.
- Statutory PAYGO’s Section 4(g).
- found in section 4(g) of the Statutory Pay-As-You-Go Act of 2010;
- applies to legislation that affects direct spending or revenues, known as a PAYGO bill, in which OMB records its budgetary effects on its own scorecards;
- allows Congress to designate any provision of a PAYGO bill as an emergency and;
- prevents the budgetary effects of designated provisions from being included in the scorecard and contributing to any potential requirement for a sequester.
Key Programs
Authorized by the CARES Act and implemented by the Small Business Administration (SBA), the Paycheck Protection Program (PPP) is a loan program designed to provide a direct incentive for small businesses to keep their employees on the payroll. The loan is eligible for full forgiveness if at least 60% of the funds are used for payroll costs, with the remaining funds being used for interest on mortgages, rent, or utilities. Forgiveness is reduced if the number of full-time employees declines, or if salaries and wages decrease. Loans not forgiven have an interest rate of 1 percent. Loans issued prior to June 5, 2020 have a maturity of 2 years, loans issued after that date have a maturity of 5 years, and all loan payments will be deferred for six months. Since its establishment, the PPP has been amended three times. First, by the Paycheck Protection Program and Health Care Enhancement Act, which provided and additional $310 billion in loan commitment authority. Then, by the Paycheck Protection Program Flexibility Act, which amended the loan maturity date, raised the non-payroll portion of a forgivable covered loan amount from 25% up to 40%, and made loan recipients eligible to defer payroll tax payments. And finally by S. 4116, which extended the application period for PPP loans through August 8, 2020. In total the Paycheck Protection Program has the commitment authority to provide $659 billion in loans to small businesses, and to date has approved more than 5 million loans with the total value of just over $520 billion. This program expired on August 8.

In response to the dramatic increase in unemployment resulting from the COVID-19 pandemic, lawmakers enacted multiple changes to the unemployment insurance (UI) system. Most notably, the CARES Act created three new programs that significantly expand UI eligibility and benefits:
1) The Pandemic Unemployment Assistance program provides up to 39 weeks of unemployment benefits through the end of 2020 to individuals not otherwise eligible for UI benefits. Benefits are calculated the same way as state UI benefits but cannot be lower than 50% of the average UI benefit in the state.
2) Federal Pandemic Unemployment Compensation provides a $600 per week supplement through July 31, 2020 to all UI and PUA beneficiaries.
3) Pandemic Emergency Unemployment Compensation provides up to 13 additional weeks of federally-financed UI benefits for individuals who have exhausted regular benefits through the end of 2020.

The CARES Act created the Coronavirus Relief Fund (CRF), which provides $150 billion in direct assistance to states, localities, territories, and tribal governments to help cover unforeseen expenses related to COVID-19. The CARES Act requires that $139 billion be allocated to the 50 state governments, with allocations based on population and with no state receiving less than $1.25 billion; $8 billion to tribal governments; and $3 billion to D.C. and the territories. Among other restrictions, CRF funds only cover eligible costs incurred from March 1, 2020 to December 30, 2020. The Inspector General of the Treasury Department determines whether CRF payments are used for eligible purposes.

The Education Stabilization Fund (ESF) established in the Coronavirus Aid, Relief, and Economic Security Act (CARES Act; P.L. 116-136) is administered by the U.S. Department of Education (ED) and has an appropriations level of $31 billion for FY2020. These funds are available through September 30, 2021. The ESF is composed of three emergency relief funds:
(1) A Governor’s Emergency Education Relief (GEER) Fund. $3.0 billion. Funds are awarded based on Elementary and Secondary Education Act (ESEA) formula. Governors may use the grants to provide emergency funds to local educational agencies (LEAs), institutions of higher education (IHEs), or education a related entity within the state for any activity authorized under various federal education laws to the provision of child care and early childhood education, social and emotional support, and the protection of education-related jobs.
(2) An Elementary and Secondary School Emergency Relief (ESSER) Fund. $13.2 billion. Awarded to states based on share of ESEA-Title I grants. State educational agencies (SEAs) must provide 90% of the funds to LEAs to be used for any activity authorized under various federal education laws, coordination of preparedness and response to the coronavirus emergency, technology acquisition, mental health services, and activities related to summer learning.
(3) A Higher Education Emergency Relief Fund (HEERF). $14.0 billion. 90 percent of funds are awarded to IHEs based on shares of full-time equivalent (FTE) Pell Grant recipients, 50 percent of which must be used for emergency aid to students. 7.5 percent is made available to minority serving institutions (MSIs). 2.5 percent is made available to IHEs through the Fund for the Improvement of Postsecondary Education Program (FIPSE). Grants under the MSI and FIPSE programs may be used for emergency financial aid grants, to cover costs associated with changes to the delivery of instruction, and to defray institutional expenses.
In addition, from the $31 billion in the total appropriation for the ESF, the Secretary of Education is required to reserve up to:
One-half of 1 percent for formula grants to the Outlying Areas of the United States, specifically: the US Virgin Islands (VI), Guam (GU), the Commonwealth of the Northern Mariana Islands (CNMI), and American Samoa (AS). Money made available from these grants will be used in response to the coronavirus and will be calculated via formula. Each Outlying Area will receive two block grants, one made to Governors' offices and one made to the State Education Agency (SEA). Each grant will have its own Certification and Agreement and its own uses of funds.
One-half of 1 percent for programs operated or funded by the Bureau of Indian Education. ED signed an agreement with BIE on June 12, 2020, to govern the terms of the funds and transferred funds to BIE on June 15, 2020.
One percent to provide competitive grants to the states with the “highest coronavirus burden” to support activities under the ESF. The statutory language does not define “highest coronavirus burden” or indicate how this should be determined. ED announced that two types of competitive grants would be awarded: (1) $180 million for Rethink K12 Education Models Grants (ESF-REM Grants) (ED awarded these funds to 11 states on July 29, 2020), and (2) $127.5 million will be made available for Reimagining Workforce Preparation Grants (ESF-RWP Grants) (the grant application closed on August 24th).
