In response to the unprecedented crisis presented by COVID-19, Congress has passed legislation responding to the pandemic and its economic fallout that together totals trillions of dollars. The Congressional Budget Office says that the federal government is on track to spend more than $3.3 trillion more than we take in this year, without any new COVID legislation.

There are currently three separate emergency designations available to senators for budget enforcement purposes in budget law and rules. Each of these designations can exempt the budgetary effects of covered provisions from specific enforcement regimes. These designations, discussed briefly below, can be challenged by any senator through the point of order process. The emergency designation points of order require 60 votes to waive, if raised. If sustained, the point of order removes the emergency designation from the pending measure and makes the budgetary effects of the provision subject to standard enforcement.

- found in Section 4112 of the Concurrent Resolution on the Budget for Fiscal Year 2018, H.Con.Res.71;
- provides the authority to designate provisions of direct spending or receipts legislation (generally produced by one of the authorizing committees) or appropriations for discretionary accounts (produced by legislation from the Appropriations Committee) as an emergency; and
- prevents Senate scorekeepers from including the budgetary effects of designated provisions in their calculations for enforcement.
- BBEDCA’s Section 251.
- found in section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 (BBEDCA);
- allows for cap adjustments to statutory discretionary spending limits, with the only requirement being that Congress designate and the president agree;
- triggers the chairman of the Budget Committee to file changes to the Appropriations Committee’s allocation and budgetary aggregates to accommodate the emergency spending and prevent levels-based points of order (314(a) of the Congressional Budget Act of 1974); and
- gives the Office of Management and Budget (OMB) the ability to adjust the statutory caps.

- found in section 4(g) of the Statutory Pay-As-You-Go Act of 2010;
- applies to legislation that affects direct spending or revenues, known as a PAYGO bill, in which OMB records its budgetary effects on its own scorecards;
- allows Congress to designate any provision of a PAYGO bill as an emergency and;
- prevents the budgetary effects of designated provisions from being included in the scorecard and contributing to any potential requirement for a sequester.
